«Yandex» added drone attacks to the list of force majeure events

Private draft

“Yandex” has updated its user agreement and added drone attacks to the list of force majeure events that may exempt the company from liability. The changes were made after drone attacks on the company’s data centers in Sasovo, Ryazan Oblast, and in Kaluga on October 8 and 9.

As reported by ASTRA, the document describes drone attacks as force majeure circumstances, “arising beyond the will of the parties and beyond their reasonable control, and which make proper performance of the parties’ obligations impossible”. In the same list, “Yandex” included the consequences of military actions, natural and sanitary threats, terrorism, emergency situations, including major man-made disasters, as well as the adoption by government authorities of acts that make performance of the obligation impossible.

The company said that these provisions are already included in the terms of use of many Yandex services. It clarified that they are now being standardized across all of the company’s services.

“Yandex” also said that the changes are clarifying in nature and do not alter the existing legal mechanisms. The user agreement was updated after the attacks on October 8 and 9 on the company’s data centers in Sasovo, Ryazan Oblast, and in Kaluga.

The company noted that no one was injured as a result of the attacks, but the infrastructure was damaged. The report refers to two Yandex facilities in Ryazan and Kaluga oblasts.
