PACE proposed not recognizing the new State Duma and preserving Russian cases in the ECHR

Private draft

The Parliamentary Assembly of the Council of Europe adopted two resolutions — on the elections in Russia and on the ECHR’s refusal to consider 879 applications from Russians. In the elections document, PACE proposes not recognizing the new State Duma as the democratically elected and legitimate representative of Russian citizens.

In the elections resolution, the assembly also proposes limiting interaction with the State Duma and imposing sanctions against the organizers. PACE condemns Russia’s holding of elections in the temporarily occupied territories of Ukraine, the lack of international observation, pressure on the opposition and the media, as well as the exclusion of Yabloko from the elections.

Separately, the assembly expresses concern about the severe humanitarian situation in the occupied Oleshky in the Kherson region. Russia-linked sabotage, arson, and assassination attempts in Europe, PACE proposes to regard as acts of state terrorism, and also calls for restricting the issuance of tourist visas to Russians and the movement of Russian diplomats.

At the same time, PACE proposes protecting emigrants from persecution and supporting the democratic forces of the Russian Federation. The idea of an amendment to preserve the materials of 879 individual complaints against Russia, the consideration of which the ECHR stopped in early September, arose at a round table of the Anti-War Committee of Russia and was supported thanks to the work of the PACE Platform for dialogue with Russian democratic forces.

In the ECHR resolution, the assembly believes that Russia is obliged to comply with court decisions on violations committed before September 16, 2022, and that this obligation does not disappear over time. The document provides for the search for mechanisms to pay compensation from Russian state assets, personal sanctions against those responsible for serious violations, and the creation of a mechanism for payments to applicants who won cases against Russia.

As a separate point, PACE proposes using Russian assets to secure compensation already awarded. The assembly proposes separately directing frozen assets of the Russian Central Bank to payments to Ukraine in interstate cases related to the war. The publication also notes that the earliest of the 879 complaints was filed almost 20 years ago.
